The course will provide an overview of the developments of the German Media Order as well as current challenges. The regulatory regime in Germany is intensively coined by the German Federal Constitutional Court to ensure pluralism of content and actors. The course will therefore provide an analysis of the guarantees of the German constitution and its application by the Federal Constitutional Court as well as the guarantees provided for by the European Convention of Human Rights and its application by the European Court of Human Rights. This order faces nowadays challenges from the regulatory issues in the EU as well as from developments of new forms of digital communications which go along with the general process of digitization. Demands for a new regulatory regime are therefore an important part of the media law discussion in Germany and the EU.
The course aims not only at an analysis of the current (and future) media law in Germany and the EU but will also provide an overview about the role of German and European Courts and their interplay. The function of basic rights and their interpretation by the courts will also be part of the course.
